the statute has nothing to do with photography or filming, it has to do with being a spectator at an illegal road takeover event, and if you are filming then you are considered a spectator. It is a rule against spectating illegal motor vehicle acts. all you would have to do is prove you where not a participant and that you did not show up with knowledge that this event was going to be performed or that you weren't there for the sole reason to watch illegal wheelies or stunt driving. If you said for example you where there to document any potential interaction between the police and spectators as a matter of public interest, and had documented this type of interaction before on a youtube channel they would be hard pressed to make that sort of charge stick.

again it has nothing to to with public photography, only if you are photographing you "could" be defined as a participant.
