Ok, this is a topic I brought up a while ago. While the USCG may have the authority to board vessels unannounced and conduct inspections in INTERNATIONAL waters it's clearly UNCONSTITUTIONAL for them to do so on private vessels in U.S. waters or on inland lakes. Your 4th Amendment right to unreasonable searches and seizures doesn't change just because you're in a boat. The police can't just pull you over to conduct an inspection of your car and then search it for no reason. They must have RAS at the very least or PC to conduct a warrantless search. If that's the case with your car on U.S. soil why would it be different if you're on a boat within the territorial waters of the United States? I looked up the federal law that Congress passed that in fact does give the USCG authority to do these things however it needs to be challenged in federal court because it's obviously a violation of the 4th Amendment. Keep in mind I'm NOT speaking of border searches when you're entering into the U.S. but instead a domestic vessel sailing in U.S. waters. For instance, what right does the USCG have to board a non-commercial vessel sailing on Lake Michigan to conduct an "inspection" without any RAS or PC crime is afoot?…..THEY DON'T, it's a 4th Amendment violation. I have a boat and if ANY LEO, be it local or federal attempts to board my vessel absent RAS or PC a crime is taking place it will be met with force – then the lawsuits will come.

Just because ignorant and arrogant legislators propose a bill and other equally ignorant legislators vote for it and the President signs it does NOT make it Constitutional. It only makes it approved. The SCOTUS has already ruled that any laws that are not Constitutional, do NOT have to be obeyed. Laws of this nature, as another commenter stated, MUST be challenged for its Constitutionality. This also should be done BEFORE ANY bill is up for a vote. Congress has a RESPONSIBILITY to uphold the Constitution, and BLINDLY writing and passing bills without checking on the legality of it is IRRESPONSIBLE
